The Board of Adjustment hears appeals and can grant conditional use permits based on their interpretation of the Unified Development Ordinance and the Kannapolis Zoning Map. They also hear variance requests and issue Certificates of Nonconformity Adjustments. Please see the current City of Kannapolis Fee Schedule to determine applicable fees. A General Application should be included with each type of application as well.
Conditional Use Permits are required for certain uses as determined by the Permitted Uses Table (Table 4.6-1) of the Unified Development Ordinance. These uses require individual review by the Board of Adjustment to ensure appropriateness of the use at a particular location. Review can include consideration of location, design and configuration along with other factors that would affect public safety, health or welfare.
Variance requests are necessary when certain factors limit an applicant from complying with a section(s) of the Unified Development Ordinance. Variances may be granted only if the applicant establishes that a hardship exists. Upon proof of a hardship through the variance process, the Board of Adjustment may allow exceptions to the regulations of the Unified Development Ordinance.
The Board of Adjustment hears appeal cases when an applicant believes the zoning administrator has not properly interpreted the Unified Development Ordinance.
Certificates of Nonconformity Adjustment are necessary when an existing nonconforming use or structure is being modified or enlarged. A non-conforming use or structure is a use or structure that existed prior to the adoption of the Unified Development Ordinance (UDO) which does not presently conform to the standards of the UDO.
The Board meets the first Tuesday of each month, at 6 p.m. at the Kannapolis Train Station located at 201 South Main Street.

Applications must be submitted by the first Friday of the month prior to the hearing.
Another factor in the timeline of cases heard by the Board of Adjustment is that there is a limit of three cases per meeting.
For example: If an application is submitted by March 6, 2009, the case would be placed on the April 7, 2009 agenda. However, if there were already three cases on the April agenda, the case would then be moved forward to the May agenda. Cases are scheduled in the order in which they are received.
The Board of Adjustment typically meets the first Tuesday of each month. The Board of Adjustmet has a limit of 3 cases per month. Cases are heard on a first come, first serve basis.
